1. ACCEPTANCE OF TERMS
By accessing this website, creating an account, purchasing any listing package, advertising package, upgrade, signage, or related service through Premier Private Sellers Pty Ltd (“Premier Private Sellers”, “we”, “us”, or “our”), you agree to be legally bound by these Terms and conditions and any other policies published on this website.
If you do not agree with these Terms and Conditions, you must not use this website or our services.
2. OUR SERVICES
Premier Private Sellers is an Australian For Sale By Owner (FSBO) property marketing platform that assists private property owners to advertise residential, rural, land and commercial property for sale or rent.
Our services may include but are not limited to:

  • online property listing creation;

  • advertising syndication to third party property portals including realestate.com.au, Domain and others where available;

  • optional premium listing upgrades;

  • professional signboards and marketing materials;

  • property brochure and flyer creation;

  • lead forwarding and enquiry management tools;

  • optional professional photography, copywriting and marketing upgrades;

  • customer support assistance.

Premier Private Sellers is a marketing and advertising service provider only. We do not act as your selling agent, buyer’s agent, conveyancer, solicitor, valuer, building inspector, mortgage broker or financial adviser.
3. CUSTOMER ELIGIBILITY
By purchasing or using our services, you warrant that:

  • you are the legal owner of the property being listed, or are authorised in writing by the legal owner to advertise the property;

  • all information supplied by you is accurate, current and not misleading;

  • you have the legal right to sell, lease or market the property;

  • you are over 18 years of age and legally capable of entering into binding agreements.

We reserve the right to request proof of ownership, identification, rates notices or other verification documents before publishing any listing.
4. PROPERTY LISTING APPROVAL & PORTAL COMPLIANCE
All listings submitted to Premier Private Sellers are subject to manual review and approval.
We reserve the right to amend, reject, delay, suspend or remove any listing that:

  • breaches property portal advertising rules;

  • contains false, misleading or deceptive information;

  • contains offensive, unlawful or inappropriate content;

  • contains prohibited imagery, watermarks or contact details in photographs;

  • advertises a property the customer is not legally entitled to market.

Customers acknowledge that third party advertising portals such as realestate.com.au and Domain have their own rules, editorial requirements and acceptance criteria which may change at any time.
Premier Private Sellers does not guarantee acceptance, placement position, editorial timing, enquiry volume, buyer response, or sale outcome on any third party portal.
5. CUSTOMER RESPONSIBILITIES
The customer is solely responsible for:

  • all wording, photos, floorplans and information supplied for publication;

  • ensuring all descriptions are truthful and legally compliant;

  • responding to buyer enquiries;

  • conducting inspections;

  • negotiating with buyers;

  • obtaining legal contracts and conveyancing advice;

  • complying with all state-based property disclosure laws.

Premier Private Sellers may provide general guidance only and does not provide legal or licensed real estate advice unless expressly stated.
6. FEES AND PAYMENT
All fees displayed on this website are in Australian Dollars and include GST unless stated otherwise.
Payment is required in full prior to publication of any paid advertising package, upgrade, signboard, premium portal feature or associated marketing service.
By making payment, the customer authorises Premier Private Sellers to commence setup, processing, artwork preparation, account creation, syndication submission and administration of the purchased services.
7. REFUND POLICY
Due to the immediate administrative work, account provisioning, advertising setup, portal processing, artwork creation and merchant fees incurred once an order is placed, all payments are generally non-refundable.
Refunds may only be considered where:

  • Premier Private Sellers is unable to provide the purchased service; or

  • required by Australian Consumer Law.

No refund is payable merely because:

  • the property does not sell;

  • the customer changes their mind;

  • the customer withdraws the property after listing work has commenced;

  • the customer receives fewer enquiries than expected.

Any approved discretionary refund may be less reasonable administration, design, processing and third party costs already incurred.
8. SIGNAGE, PRINT & ARTWORK
All signboard, brochure, flyer and artwork designs remain the intellectual property of Premier Private Sellers until paid in full.
Print colours, material finishes and final production output may vary slightly from on-screen proofs.
Customers are responsible for approving final artwork prior to printing.
No refunds are available on custom printed items once production has commenced.
9. NO GUARANTEE OF SALE OR TIMEFRAME
Premier Private Sellers provides advertising exposure and self-sale tools only.
We do not guarantee:

  • that your property will sell;

  • that your property will sell within any particular timeframe;

  • that your property will achieve any specific price;

  • that enquiries will be generated from any portal.

Property market conditions, pricing, presentation, location, negotiation skill and buyer demand are outside our control.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Premier Private Sellers excludes all liability for:

  • loss of profits;

  • loss of opportunity;

  • loss arising from delayed listing publication;

  • third party portal downtime or feed interruption;

  • buyer conduct;

  • listing ranking changes;

  • indirect or consequential loss.

Our maximum liability for any claim relating to our services is limited to the amount paid by the customer for the relevant service.
11. INDEMNITY
The customer indemnifies and holds harmless Premier Private Sellers, its directors, staff, contractors and affiliated entities against any claims, damages, legal actions, portal breaches, misleading advertising claims or disputes arising from:

  • inaccurate information supplied by the customer;

  • breach of these Terms;

  • disputes between customer and buyer;

  • unlawful use of photos or content provided by the customer.

12. WEBSITE USE
All content on this website including text, graphics, branding, pricing, logos, designs, calculators, software, package structures and marketing material is owned by or licensed to Premier Private Sellers.
No part may be copied, reproduced or distributed without written permission.
We may suspend, update or alter the website and any pricing, package inclusions or service offerings at any time without notice.
13. PRIVACY
Your use of this website and our services is also governed by our Privacy Policy.
By submitting enquiries or purchasing services, you consent to us collecting, storing and using your personal information for the purpose of delivering our services, communicating with you and processing your property advertising campaign.
14. GOVERNING LAW
These Terms and Conditions are governed by the laws of Queensland, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of Queensland.
15. CHANGES TO THESE TERMS
Premier Private Sellers may amend these Terms and Conditions at any time by publishing updated Terms on this website.
Continued use of the website or our services constitutes acceptance of the amended Terms.

5. ACCESS AND CORRECTION

REFUND POLICY
All Premier Private Sellers packages involve immediate administrative setup, portal processing, merchant fees, artwork preparation and backend labour once ordered.
Accordingly, all purchases are generally non-refundable except where required under Australian Consumer Law.
Refund requests may be considered solely at our discretion where:

  • the purchased service cannot be supplied; or

  • a duplicate payment has been made.

No refunds are provided for:

  • change of mind;

  • property withdrawn from sale;

  • dissatisfaction with enquiry levels;

  • delayed seller response;

  • property not sold.

Custom printed products, signboards, brochures and bespoke marketing work are strictly non-refundable once approved for production.
SELLER SERVICE AGREEMENT
By purchasing any advertising package, the customer appoints Premier Private Sellers solely as a marketing service provider to facilitate online property advertising.
The customer acknowledges that:

  • Premier Private Sellers is not acting as a licensed real estate agent representing the seller in negotiations;

  • all buyer communication and negotiations remain the seller’s responsibility;

  • the seller remains responsible for obtaining contracts, legal disclosure documents and conveyancing advice;

  • Premier Private Sellers may submit, edit and maintain advertising data on the seller’s behalf for portal compliance purposes.

The customer grants Premier Private Sellers permission to:

  • use supplied photographs and descriptions;

  • create edited marketing content;

  • syndicate listings to external portals;

  • communicate listing-related enquiries.

WEBSITE DISCLAIMER
